Vision arrangements for grandparents

We are all aware of the fact that it is of crucial importance to have a multi-generational relationship between grandparents and grandchildren, and in most normative families, grandparents are an inseparable part of their grandchildren's lives from the earliest moments of their lives. When we deal with the relationship between grandparents and grandchildren after parents' divorce, studies show that the relationship with the grandparents is weakened by the parent who is not the custodian (usually the father) and is strengthened with the permanent custodian (usually the mother). In more complex cases, grandparents encounter refusal to meet with their grandchildren and attempts to sever ties between them.

This creates a situation in which a law has been created in recent years to establish vision arrangements for grandparents with grandchildren in order to prevent the custodial parent from robbing them of their natural right and one of the most important and useful experiences offered by the intergenerational relationship to children – grandchildren and grandparents. The Law for the Arrangements for Vision for Grandparents will regulate the right of the child to maintain reasonable contact with his grandparents – a right that is consistent with the principle of the best interest of the child and which works first and foremost for his benefit and only afterwards satisfies the desire of his grandparents to contact him. For children who have experienced a divorce procedure, especially in cases where the extended family is required to bear the burden of child support when their parents are unable to do so.

Legal Capacity and Guardianship

In 2007, a new regulation was passed that regulates the right of grandparents to sue the parent to allow for seeing arrangements with the grandchildren. The Basic Law establishes vision arrangements between grandparents and their grandchildren when one of the grandchildren's parents dies. However, as part of the expansion of the law it was determined that it can be used in any case where one of the parents is detached from the child's life and the routine of his treatment. In other words, even in cases of medical or mental problems that prevent the separated parent from being able to care for the child, including cases in which a parent is declared absent, a parent whose right to serve as guardian to his children has been revoked and in some cases even in divorce cases in which one parent prevents continuous contact between the grandparents and the grandchildren. It is important to emphasize that each case must be examined on its merits, and the policy of the law always operates according to the principle of the child's right to maintain a continuous and productive relationship with his extended family.

Vision arrangements for grandparents with grandchildren

In cases where there is an attempt to separate the grandparents from their grandchildren, the grandparents have the right to apply to the Family Court so that it will force the parents to make arrangements with the grandchildren and ensure that the grandparents will enjoy quality time with their grandchildren, regardless of the wishes of the parents. It is important to emphasize that there were cases in which the court examined the case before me and ruled that in favor of the grandchildren, in particular, Not to allow contact with the grandparents, for fear of harm to the parent who remained or the children to him.

Humanly, most of us are aware of the benefits of inter generational relationships and agree that the law should give grandparents the right to view their grandchildren – since they do not have to suffer intentional revenge behavior on one or both of their parents. All the more so when we are dealing with special cases such as a parent who is the son of the grandparents, he dies and the child is the male and the only surviving child, or one or both parents experience a process of repentance and refusal to bring together a different lifestyle.

Legally, there are cases in which the court rules that grandparents should bear the burden of child support when their son, the father, can not pay or escape from his obligation. Therefore, the demand for visual arrangements for grandparents is logical and acceptable – since if the legislator sees them as responsible for the payment of the benefits, he must also see and recognize their right to contact the grandchildren.

In the best interests of the child, each case must be examined on its own merits, and the most appropriate decision should be taken, and to remember that the prevention of close contact with the grandparents is often irreversible … since the grandparents are not young and sometimes the contact may be too late. Such a situation may lead to the moment when the young child grows up and then realizes that they have prevented him from being able to meet his grandparents and develop their special relationship with them and now it is too late.

Claiming vision arrangements with grandchildren

In order for the grandparents to have access to seeing with their grandchildren, they must prove that preventing contact with their grandchildren is done for extraneous reasons and not for matters and does not serve the child's well-being. Therefore, it is very important and decisive that the grandparents be assisted by an expert family lawyer who knows the secrets of the law and the law in order to see grandparents, who has helped many grandparents to maintain productive and healthy relations with their beloved grandchildren if such a connection is prevented for no reason.

Remember: A good and fruitful relationship between grandparents and grandchildren contributes to the development of the child's personality. The relationship between the child and his grandfather gives him emotional security in the psychological aspect and serves as a historical intergenerational bridge that creates a sense of security in the social aspect. If you, too, avoid significant contact with your grandchildren unjustly and without reason, you do not have to accept it.
